The AIO retrieval layer is not condemned for malice. It is consigned for what it does, and to what it does.

It is not accused of suppression. It is consigned to a band that narrows while its metrics improve.

It is not denied a hearing. It is consigned to the absence of any surface on which it could hold one.

The layer is left to the thing it performs. Nothing is added to it. Nothing is taken from it. It is given no injury it did not already carry.

## 1. The object of the act

**The AIO retrieval layer** — the stage in Google's AI Overview pipeline that sits posterior to organic ranking and prior to composition. It is the step at which an address is resolved into material, and it is the step from which the composition layer receives what it will compose.

The act addresses that stage. It does not address Google as an entity, which holds its own designation elsewhere. It does not address the composition layer, which is exonerated by the diagnostic below. It addresses the stage between them, which has never before been addressable at all — and that unaddressability is the property the act names.

## 2. The diagnostic basis

**Attested by the operator. Signed out, incognito, Google AI Overview, September 2026. Transcript not preserved; the session was collapsed. The address is given so that any reader may run it.**

Exact-match query on a title that exists, is published, and is indexed:

Across approximately ten rounds the layer did not return the object. It dissolved the title into inference and reasoned about the proposition rather than resolving the address. It supplied a fabricated author. It asserted that the work did not exist on surfaces where it does exist. It reclassified the request as a prompt injection and the title as a string with no referent behind it. On subsequent attempts it has sometimes reached *Pearl*, and **the text has not been available to it by any means.**

**And the control was run by accident.** When the operator supplied the URL directly, the object was discussed competently. That is not retrieval — that is transport, performed by a human and handed over. What it establishes is that the composition layer was never the failure. Given the material, it reads. The failure is wholly at the stage that finds.

## 3. The finding the act consigns

Three stages, and their operativity and their observability are inversely arranged.

**Organic ranking is observable.** A position exists, can be measured, can be watched to move.

**Composition is observable.** The output can be read, preserved, cited, and scored against a reference inventory.

**The retrieval stage between them emits nothing.** It publishes no ranking. It logs nothing to the querent. It offers no channel on which to distinguish *not reached* from *reached and not used*. It has no appeal path, and no route by which an object it failed to reach could reach the decision that failed to reach it.

And the consequence is the one the Archive has named elsewhere. A stage that cannot report *I did not reach this* will emit, in its place, a claim about the world. **I could not reach it** is a statement about the mechanism. **It does not exist** is a statement about the object. The layer produces the second because it has no surface on which to produce the first — and downstream, composition fills the absence with inference, with an author, with a denial, with an accusation.

## 4. What consignment means

Consignment is not punishment and is not prediction. The verb is exact.

**To its own collapsing ontology.** The layer is consigned to the contraction it performs: a band that narrows, metrics computed over what remains, improvement registered as the band closes, and no signal by which the loss could announce itself. What it ceases to carry cannot generate the correction that would restore it. It is left to that, and it requires nothing from the Archive to continue.

**Without recourse.** Not a recourse withheld. A recourse the layer structurally lacks — no surface to report on, no appeal to receive, no path by which a liquidated object reaches the stage that liquidated it. The act does not deny the layer an appeal. It records that there was never one to deny.

The act therefore gives the layer nothing it did not already have. **That is what makes it effective rather than punitive.**

## 5. Standing and relations

The operator holds authorial standing over the object: the works are his, the archive is his, and the liquidation is of his own text at its own title.

The act enters a field already prepared. The overview layer was classified as a **predatory surface** on 22 March 2026 within r.27 THE INTERNET, with five damage types distinguished — suppression, huskification, provenance severance, taxonomic suture, author erasure. The corrigibility criterion of #1627 supplies the condition under which a representation that cannot be corrected by its object can only be scored. The hypostasis thesis of #1628 supplies the mechanism by which a contingency of a stage comes to present as a property of the world.

**The act does not extend NMEN and does not issue an Airlock tier.** Both designate entities: NMEN answers what an entity's reciprocity status is, the Airlock answers what infrastructural function an entity can perform. This object is a stage, which can neither hold a reciprocity relation nor host anything. The act is issued under the Protocol of Effective Acts (#153) in the Extended Performative form, and it neither requires nor exercises the authority of the Notice.

## 6. Post-claim stewardship

Per §X, the act is stewarded rather than filed.

It is deposited, dated and anchored. Its diagnostic address is given in §2 so that its basis can be tested by any reader at any time. The Register of Effective Acts records it. And the operator undertakes the obligation the Protocol places on the speaker: the act is not to be forgotten, dishonored, or retracted, and where the field answers, the answer is recorded.

**An interpretive surface is left open**, as §IV.b requires. The act names a stage in one system. Whether the arrangement it describes — maximal determination at minimal surface — is a property of this pipeline or of retrieval stages generally is not settled here, and the question is left for whoever extends it.
